Beyond the «end of Sename»: Residential care for children and the constituent process

Abstract

The Chilean residential protection system has been harshly criticized for failing to guarantee an adequate protecting and caring environment. This paper focuses on the main challenges that must be addressed in the ongoing constitutional process in order to overcome the structural causes underlying the crisis of the Chilean residential system. Drawing from documentary research, and a descriptive and critical analysis, this article argues that the current Chilean residential protection system does not comply with the human rights model. With a strong emphasis on charity, the Chilean State has tended to delegate responsibility of children’s care and protection to private entities, seriously compromising children’s exercise of their rights. Therefore, if the constituent process shall deal with the so-called «Sename’s crisis», it must culminate in a state model that assumes its responsibility and position as guarantor of children’s human rights.

Diplomada en Pueblos Indígenas, Medioambiente y Procesos de Diálogo en el marco del Convenio 169 de la OIT por la Universidad de Chile, y en Derechos de la infancia y litigio estratégico frente al sistema interamericano de derechos humanos por el Instituto Interamericano de Derechos Humanos.
