Mass Segregation and Actuarial Financial Balance in the Regime Próprio de Previdência Social

Abstract

With the Federal Constitution of 1988, the Regime Próprio de Previdência Social-RPPS became used by several federated entities, although there were no minimum legal standards. In this research the evolution of the constitutional rule on RPPS was examined in relation to the coexistence of the principles of financial and actuarial balance and solidarity in the hypothesis of the use of mass segregation as a way of equating the system. The technique of documentary analysis and bibliographical review was used in order to ascertain data of the legislation, doctrine and decisions of the Federal Supreme Court on the subject. As a result, there is a difficulty in harmonizing the principles of solidarity and financial and actuarial balance in the occurrence of mass segregation
